The requirements for filing for divorce in Nebraska are: 1) one of the spouses must have been a resident of Nebraska for at least one year; or 2) the marriage must be performed in Nebraska and one of the spouses should have lived in Nebraska for the entire marriage. The dissolution of marriage may be filed for in a county where either spouse resides. [Revised Statutes of Nebraska; Chapter 42, Section 348].

Grounds for divorce for Nebraska:

The only no-fault ground for dissolution of marriage in Nebraska is: Irretrievable breakdown of the marriage. [Revised Statutes of Nebraska; Chapter 42, Section 361]. Dissolution of marriage will only be granted if reasonable efforts for reconciliation have been made. If the court deems there is some reasonable possibility of reconciliation, dissolution of marriage actions may be transferred to a conciliation court or the spouses may be referred to a qualified marriage counselor, family service agency, or other agency which provides conciliation services. Official conciliation counselors are available in counties of over 250,000 persons. [Revised Statutes of Nebraska; Chapter 42, Sections 360 and 808].

Apart from this the grounds for a fault based divorce can be filed on the grounds of a spouse's mental incapability to consent a marriage.

When you are filing for a divorce in Nebraska, you can either do a divorce on an agreed basis or by default. The reason for divorce is not considered for either of the divorce grounds.

An agreed divorce, as the name suggest is agreed by both the spouses. Spouses generally agree upon a few terms such as property distribution, parental responsibilities and child custody. In this kind of divorce both the parties have to sign the divorce papers and should be present for all the court hearing. This method is accepted by most people in Nebraska and is considered one of the most preferred methods of taking a divorce.

A default divorce on the other hand is not signed by both the parties. In fact the entire process of divorce is carried by one of the spouses. The other spouse just defaults on the case. In a default divorce, the spouse filing for divorce usually gets everything that is been asked for in the divorce papers.
