Both spouses must be a resident of Kansas for 60 days immediately before filing for divorce. The divorce may be filed for in a county where either spouse resides. Grounds for divorce:

The only no-fault divorce for Kansas is: Incompatibility. [Kansas Statutes Annotated; Chapter 60, Article 16, Subject 1601].

However, a person filing a do it yourself divorce can obtain a divorce on an agreed basis or default. An agreed divorce is the most common type of divorce in Kansas. It is signed by both the parties signifying that they agreed upon the terms and conditions of a divorce. Usually spouses agree upon terms such as property distribution, alimony, child support and custody. An agreed divorce can guarantee a quick and hassle free separation, and thereby very popular among people who wish to opt for a divorce.

A default divorce on the other hand is not signed by one of the parties. The other partner has either not responded to the summons of the court or is unavailable to respond. In such cases divorce is still granted, however, the petitioner needs to submit proofs in the court that the summons was received by the respondent. In case the other spouse is missing, ample proof of the petitioner trying to locate the respondent needs to be presented to the court. This might include a write-up in the newspaper or other mediums. In the default case, the other spouse's consent for divorce is taken by default. The spouse who files the case usually gets everything that they wish to desire or as stated by law. The final decision of the court is binding on both parties.

Filing a divorce

Kansas divorce can be summed up in three easy processes, which is as follows:

  • Filing the papers: A divorce petition is filed by the petitioner along with the necessary documents that need to be settled in the divorce case.
  • Notifying the spouse: Usually a court summons reaches the respondent. However, it is advisable that the respondent is informed well in advance about you filling a divorce. It is the duty of the respondent to file an answer to the petition in agreement of the divorce. In case if the respondent does not agree to the terms of the divorce or the grounds on which divorce is obtained, a counter petition is filed. This might lengthen the case.
  • Attending the court hearing: The divorce hearing is scheduled by the petitioner. The final hearing is scheduled on a date after completing 60 days from the date of filing the papers.
